1. Agreement
By downloading or using ToothPal ("the app") you agree to these terms. If you do not agree, do not use the app.
The app is licensed to you, not sold. mydy Ventures grants you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, as permitted by the App Store or Google Play terms you obtained it under.
If you obtained the app from Apple, these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them against you.
2. Your account
You sign in with Apple or Google. You are responsible for keeping access to that account secure and for everything done through it. You must be 18, or the age of majority where you live, to create an account.
Scan only your own mouth. Do not upload images of another person without their informed consent.
3. Subscription & billing
- What it unlocks: the paid tier is described in the app on the purchase screen, which is the authoritative description at the moment you buy.
- Plans: Plus, monthly and yearly (
toothpal_plus_monthly,toothpal_plus_yearly); Companion, monthly and yearly (toothpal_family_monthly,toothpal_family_yearly); and a breath add-on (toothpal_breath_addon). Prices vary by country and change over time. The price shown in the app at the moment of purchase is always the price that governs — we deliberately do not reproduce it here, so this page can never contradict the store. - Free trial: where a free trial is offered, its length is shown in the app before you confirm, and eligibility is decided by the store. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial.
- Auto-renewal: the subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Your store account is charged within the 24 hours before the period ends.
- Managing and cancelling: in your App Store or Google Play account settings. We cannot cancel a subscription on your behalf — only the store can.
- Deleting the app does not cancel your subscription. You must cancel through the store.
- Refunds are handled by Apple and Google under their own policies. We do not process payments and cannot issue a refund directly. Where local consumer law gives you a withdrawal or refund right, that right still applies.
- Price changes: if we change the price, the store will tell you and ask for your agreement before the next renewal, as its rules require.
4. Your scans
Your scan images and the scores derived from them stay yours.
You grant us only the narrow licence we need to run the service for you: to store your images, analyse them, show the results back to you, and build your trend over time. That licence exists to operate the app for you and for no other purpose, and it ends when you delete the scan or your account.
We do not use your scans to advertise to you, and we do not sell them. They are also not used to build, train or evaluate our scoring model — evaluation runs against a separate image set, never against your scans.
5. Acceptable use
Do not use the app to break the law, to upload images of someone who has not consented, to attack or overload the service, to reverse-engineer it, or to resell access to it.
6. AI and scoring
Scan analysis is performed by an AI model reading a photograph. That means:
- Scores are estimates, not measurements. Lighting, camera quality, angle and how wide you open your mouth all move the result.
- Scores are for comparison with your own history, under similar conditions — not against other people, and not against any clinical standard.
- The model can be wrong in both directions. A good score is not a clean bill of health. A poor score is not a diagnosis.
We may change how scoring works as the model improves. When we do, historical scores may be recalculated or may not be directly comparable to new ones. Where a change materially affects how your history reads, we will say so in the app.
7. Not medical or dental advice
ToothPal is a wellbeing and habit-forming app. It is not a medical device, it is not regulated as one, and it performs no clinical function. Nothing in it — no score, trend, ritual, or piece of guidance — is medical or dental advice, a diagnosis, a screening, or a substitute for examination by a qualified dentist.
It cannot detect caries, gum disease, oral cancer, or any other condition. Do not use it to decide whether you need to see a dentist, and never delay or avoid professional care because of anything the app showed you.
See a dentist if you have pain, bleeding that does not settle, swelling, a lump, a sore that will not heal, a loose tooth, or anything that worries you — whatever ToothPal says. Keep going to your regular check-ups.
8. Availability
We try to keep the app working, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features. If we withdraw something significant that you are paying for, you can cancel and, where the law requires, receive a proportionate refund through the store.
9. Ending this agreement
You can stop at any time: cancel your subscription in the store, and delete your account from this page.
We may suspend or end your access if you materially breach these terms, or if we have to for legal or security reasons. Where it is reasonable, we will warn you first and give you a chance to get your data out.
10. Liability
Nothing in these terms limits liability that cannot lawfully be limited — including death or personal injury caused by negligence, fraud, or your non-excludable rights as a consumer.
Subject to that, and to the maximum extent the law allows: the app is provided "as is"; we exclude implied warranties; and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.
We are not liable for indirect or consequential loss, nor for any dental or health outcome arising from your use of, or reliance on, the app.
11. Governing law
These terms are governed by the law of the State of Israel, and the courts of Tel Aviv-Yafo have exclusive jurisdiction. If you are a consumer, this does not remove the protection of the mandatory law of the country you live in, or your right to bring a claim there.
12. Changes
We may update these terms. The date at the top changes, and material changes are notified in the app before they take effect. Continuing to use the app after that means you accept the new terms.
